Terms of Service

The short version

The Rally helps pickleball players find each other. Be honest on your profile, be decent in messages, and treat people the way you'd treat them at the courts. You must be an adult. What you post stays yours; the app itself is ours. And when you meet someone from the app, you're meeting them on your own judgment and at your own risk. The rest of this page makes those points precisely. By using The Rally you agree to all of it.

Who can use The Rally

You must be at least 18 years old to create an account. The Rally arranges real-world meetups between people who don't know each other, and that's an adult activity. One account per person, under your real identity. Accounts that impersonate someone, misrepresent ratings, or exist to promote a business without our permission can be removed.

Your account

You sign in with a link sent to your email, so anyone with access to your inbox can access your account, so keep your email secure. You're responsible for everything that happens under your account. If you believe someone else has used it, contact us right away.

Your content

You own what you post: your profile, photos, bio, messages, endorsements, and venue suggestions. So the app can function, you grant The Rally a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content within the service. That's what showing your profile to nearby players is. This license ends when you delete the content or your account, except that messages you already sent remain visible to the person you sent them to. Don't post anything illegal, harassing, deceptive, or that isn't yours to post.

Our property

Everything that makes up The Rally itself, meaning the name, logo, design, software, features, text, and the compiled database of venues and community structure, belongs to The Rally and is protected by copyright, trademark, and other intellectual-property laws. We give you a limited, personal, revocable, non-transferable license to use the app for its intended purpose: finding people to play pickleball with. You may not copy, modify, distribute, sell, or lease any part of the service; scrape, harvest, or bulk-export player or venue data; use automated tools to access the service; reverse-engineer the software; or build a competing or derivative service from it, in each case unless we give you written permission first. "The Rally" and our logo may not be used in connection with any product or service that isn't ours.

House rules

Don't harass, threaten, or demean other players. Don't spam. Don't create fake profiles or fake ratings. Don't use The Rally to advertise or solicit without our permission. Don't attempt to contact someone who has blocked you, on-app or off. Don't probe, overload, or interfere with the service's security or operation. We built this for people who love the sport. Act like it.

Meeting people is your call

The Rally introduces players; it does not vet them. We don't run background checks, verify identities beyond an email address, or supervise games. Ratings are self-reported. When you choose to meet someone from the app, play a game, or attend an event, you do so at your own risk and using your own judgment. Pickleball is a physical activity with inherent risk of injury; courts and venues are not operated by us, and their condition is not our responsibility. To the fullest extent California law allows, you assume all risks arising from in-person meetups, play, and venue conditions. Meet at public courts, and trust your instincts.

Community-maintained information

Venue details, court counts, hours, and similar information are contributed by the community and may be outdated or wrong. Verify before you travel. Map data is provided by Mapbox and subject to their terms.

Blocking, moderation, and removal

Blocking cuts contact both ways and we enforce it server-side. Reports of harassment, spam, or fake profiles are reviewed and actioned, up to and including permanent account removal. We may suspend or terminate accounts that violate these terms, create risk for other players, or abuse the service, with or without notice depending on severity.

Leaving

Delete your account any time from Settings. Deletion is permanent and removes your profile, availability, paddles, endorsements, and messages. We may retain minimal records where the law requires it or where needed to enforce these terms (for example, a record that a banned account existed).

As-is, while we build

The Rally is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We're in active development: features may change, break, or be discontinued, and we don't promise uninterrupted or error-free operation.

Limits on liability

To the fullest extent permitted by law, The Rally and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost opportunities, or personal injury arising from your use of the service or from meetups and games arranged through it. Our total liability for any claim relating to the service is limited to the greater of fifty dollars ($50) or the amount you paid us in the twelve months before the claim. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

If your conduct causes a claim

If a third party brings a claim against The Rally because of content you posted, something you did through the service, or your violation of these terms, any law, or someone else's rights, including anything arising from a meetup you arranged, you agree to defend and indemnify us: the resulting damages, costs, and reasonable attorneys' fees are yours. We may take over the defense of any such claim, you agree to cooperate with that defense, and you won't settle anything that creates obligations for us without our written consent. This section survives the closure of your account.

Disputes and California law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing any claim against us, you agree to email a written description of the dispute to support@swellset.ai and give us thirty days to try to resolve it with you informally. Most things get fixed this way. If we can't, claims that qualify for small-claims court belong there; any other dispute will be brought in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction.

California consumer notice

Under California Civil Code §1789.3, California users may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Changes to these terms

These terms are versioned (see the top of this page). If we make material changes, you'll be asked to review and accept the new version before continuing to use the app. Continued use after accepting means the new version applies.
